Protect Your Non-marital Assets

In Colorado, the general rule is that all property a couple has accumulated during the marriage is divided in the event of a divorce. There are certain exceptions to this rule. For example, gifts, inheritances, personal injury settlements and property or assets that you had before the marriage are usually considered non-marital property and do not have to be divided between divorcing spouses. Attorney Barrett has extensive experience helping clients protect their non-marital assets.

Property Subject to Division in a Divorce

  • Retirement benefits and pensions - Attorney Barrett will closely review your retirement and pension plans to protect your financial interests. He will determine if the pension plan is in your name and how the retirement plan is defined.
  • Real estate - Finding out the correct market value of your home, vacation cabin or other real estate is essential to a fair division of the equity between spouses. If you owned business property or residential real estate prior to the marriage, we will work to protect your non-marital property.
  • Investment accounts, securities and bonds - Attorney Barrett will closely evaluate your bank statements to determine how much assets you have and whether or not you made your investments before you got married.
  • Trusts and pending settlements - If you have a trust, attorney Barrett will review the trust statement to determine the beneficiary and whether the assets can be protected.
  • Personal property - Boats, cars, furniture, jewelry, household goods and other personal property are subject to division in a divorce.
